DEFINITION OF TERMS

For the purposes of this agreement, "Client" refers to any individual or entity that uses our services or accesses our website. "Services" refers to any HVAC or Plumbing-related services provided by Black Bear Heating and Air, including installation, maintenance, and repair of heating, ventilation, air conditioning, and plumbing systems.

ACCEPTANCE OF TERMS

By using our services or accessing our website, you acknowledge that you have read and understood these terms and conditions, and you agree to be bound by them. If you do not agree to these terms and conditions, you may not use our services or access our website.

LIMITATION OF LIABILITY

Black Bear Heating and Air is not liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages arising from the use of our services or the inability to use our services. Black Bear Heating and Air is also not liable for any lost profits, lost data, or other losses resulting from the use of our services.

DISCLAIMER OF WARRANTIES

Unless otherwise stated, Black Bear Heating and Air makes no warranties, express or implied, regarding the use of our services. Our services are provided "as is" without warranty of any kind. We do not warrant that our services will meet your requirements, be uninterrupted, timely, or error-free, or that the results obtained from the use of our services will be accurate, reliable, or satisfying.

WORKMANSHIP WARRANTY

Black Bear Heating & Air guarantees that all workmanship, supplied materials, and services provided will be completed in accordance with industry standards and will be free from defects in workmanship for a period of [length specified on invoice]. This warranty is non-transferable and limited to the Client named on the invoice. This warranty is subject to the following conditions:

The Client must notify us in writing of any defects or issues with the services provided within [length specified on invoice] of the completion of the work.

The Client must allow us to inspect the work and make any necessary repairs or corrections. If we are unable to repair or correct the issue to your satisfaction, we will refund the cost of the services provided.

This warranty does not cover any damage or defects caused by misuse, abuse, or neglect of the systems or equipment serviced, acts of nature, or any other causes beyond our control.

This warranty does not cover any defects or damage caused by third-party repairs or modifications to the systems or equipment serviced. This warranty is in lieu of all other warranties, express or implied. We specifically disclaim any implied warranties of merchantability or fitness for a particular purpose. 5.

INDEMNIFICATION

You agree to indemnify and hold Black Bear Heating and Air harmless from any claims, damages, or expenses arising from your use of our services or your violation of these terms and conditions.

PAYMENT

Payment for our services is due at the time of service. We accept cash, check, major credit cards, and 3rd party financing for payment. Job valued less than $1000: Full payment due at time of service Job valued greater than $1000: Minimum 40% deposit due prior to service/job scheduling, remaining balance due upon completion of quoted job. Extra Work outside of beyond job scope and/or Change Orders will be quoted prior to their start, full payment due upon completion of quoted job.

CHANGES TO TERMS AND CONDITIONS

Black Bear Heating and Air reserves the right to modify these terms and conditions at any time. By continuing to use our services or accessing our website after such modifications have been made, you agree to be bound by the modified terms and conditions.

GOVERNING LAW
